1. Service Description

Grow Local is a subscription-based website building and hosting service operated by DM. Digital Marketing LLC ("we," "us," or "our"). The service uses artificial intelligence to generate website content, including service descriptions, location pages, testimonials, and other text based on information you provide. By subscribing to Grow Local, you agree to these terms in addition to the general DM. Digital Marketing LLC Terms of Service above.

2. AI-Generated Content

Grow Local uses artificial intelligence to generate website content based on the business information you provide. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or information that does not accurately reflect your business. You are solely responsible for reviewing, approving, and editing all content on your website before and after publication. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

AI-generated testimonials are fictional and created for illustrative purposes only. They do not represent real customer experiences. You are responsible for replacing these with genuine testimonials or removing them from your website. Displaying fictional testimonials as real may violate consumer protection laws in your jurisdiction.

3. Subscription and Billing

Grow Local is offered on a month-to-month subscription basis at the price displayed at the time of purchase (currently $99/month). Your subscription automatically renews each billing period unless cancelled. All payments are processed through Stripe. You can update your payment method, view invoices, and cancel your subscription through the billing section of your client dashboard.

We reserve the right to change subscription pricing with 30 days' written notice. Price changes do not apply to your current billing period.

4. Cancellation and Refunds

You may cancel your subscription at any time through your dashboard or by contacting us. Upon cancellation, your website remains active until the end of your current billing period. After that, your website will be taken offline. We do not offer refunds for partial billing periods.

Your content is retained for 30 days after cancellation. During this period, you may reactivate your subscription to restore your website. After 30 days, your content may be permanently deleted. You may request an export of your content at any time during the retention period.

5. Content Ownership

You retain ownership of all original content you provide to us, including your business name, logo, photos, and business information. AI-generated content created by our system for your website is licensed to you for use on your Grow Local website for the duration of your subscription. Upon cancellation and content export, you may continue to use the AI-generated content.

You grant us a non-exclusive license to display your content on your website and in our marketing materials (such as showcase examples) unless you opt out by contacting us.

6. Data and Privacy

We collect and process data necessary to operate your website, including business information you provide, website visitor data (contact form submissions, phone click tracking), and billing information. Lead data (contact form submissions and call clicks) is stored in our database and accessible through your dashboard. We do not sell your data or your customers' data to third parties.

Your website visitors' data is subject to the privacy policy displayed on your website. You are responsible for ensuring your privacy policy accurately reflects your data practices and complies with applicable laws including CCPA and GDPR where applicable.

7. Website Hosting and Availability

We host your website on third-party infrastructure (Vercel) and strive to maintain 99.9% uptime. However, we do not guarantee uninterrupted service and are not liable for downtime caused by third-party providers, scheduled maintenance, or circumstances beyond our control.

We reserve the right to perform maintenance that may temporarily affect website availability. We will provide reasonable notice for planned maintenance when possible.

8. Custom Domains

You may connect a custom domain to your Grow Local website. You are responsible for domain registration, renewal, and DNS configuration. We are not responsible for domain expiration, DNS misconfiguration, or issues with your domain registrar. If you cancel your subscription, you retain ownership of your domain but must update your DNS records to point elsewhere.

9. Acceptable Use

You agree not to use Grow Local to create websites that:

• Contain illegal, fraudulent, or deceptive content
• Infringe on intellectual property rights of third parties
• Promote hate speech, violence, or discrimination
• Distribute malware or engage in phishing
• Misrepresent your business, services, or qualifications
• Violate any applicable local, state, or federal laws

We reserve the right to suspend or terminate your account if we determine you are violating these terms, with or without notice.

10. Limitation of Liability

To the maximum extent permitted by law, DM. Digital Marketing LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of Grow Local.

Our total liability for any claim arising out of or related to Grow Local shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. This limitation applies regardless of the theory of liability.

11. Search Engine Results

While Grow Local websites are built with SEO best practices, we do not guarantee any specific search engine rankings, traffic levels, or lead generation results. Search engine algorithms are controlled by third parties and are subject to change. SEO results depend on many factors outside our control including competition, market conditions, and search engine policies.

12. Modifications to Service

We reserve the right to modify, update, or discontinue any aspect of Grow Local at any time. We will provide reasonable notice for material changes that significantly affect your use of the service. Continued use of the service after changes constitutes acceptance of the modified terms.
